DED Consumer Complaints: A Step-by-Step Guide to Resolving Auto Disputes in the UAE

The purchase of any vehicle should be a stress-free process, but issues with hidden problems, substandard service or false advertising in the sales literature can make it a stressful time. The UAE, however, boasts one of the best consumer protection systems in the region, providing consumers with various means of handling automotive disputes.

Under Federal Law No. 15 of 2020 on Consumer Protection, government offices like Dubai’s Department of Economy and Tourism take care of complaints concerning dealerships, workshops and automotive industry businesses.

Know Your Consumer Rights

When a car dealership sells you an angry car, they failed to fulfill the maintenance agreement, or garbles facts when it comes to the selling, you have a legal right to file a consumer complaint! This may mean making a request for repair, refund, replacement or cancellation of the sales contract.

The government puts consumers on the debtors’ corner first in order to try to communicate with the merchant. If the problem has not been resolved, there are official channels for complaints that are available for free.

Step 1: Gather All Supporting Evidence

Proper documentation is the first step in a successful complaint. Before you submit your case, gather all documents which back up your claim.

This should include but is not limited to the invoice for the sale, receipts of payments, any contract from the dealership, any associated with the trade licence, any warranty paperwork and any receipts of repair invoice presented by the dealer and any communication with the dealer in writing. WhatsApp conversations, emails or repair job cards may even boost your case if they clearly expose promises or recognitions made by the seller.

If it is over a mechanical fault, have an inspection report completed at an authorised workshop of the manufacturer or vehicle testing centre. The best evidence at mediation is usually a professional diagnostic report.

Step 2: Select the Appropriate Government Body

Authorities for complaints are based on the dealership’s registration. In case it is purchased from a dealership located in Dubai, complaints may be made via Dubai Department of Economy and Tourism’s Dubai Consumer App, Dubai Consumer Rights portal or through the customer service hotline.

Abu Dhabi Department of Economic Development does not know of the TAMM platform where complaints can be submitted by the shops located in Abu Dhabi.

Severe cases that involve another emirate or cross-emirate transactions may be resolved by the Consumer Protection portal of the Ministry of Economy as well.

Step 3: Submit Your Complaint

Use your UAE Pass to log in to the appropriate Government website and click on the Consumer Complaint service. Fill in your personal information, dealership data, vehicle information and describe the problem in detail. 

Upload all supporting documentation such as invoices, inspection reports, photos and communication documentation. Specify what you wish: refund, repair, replacement or cancel the contract. The majority of online submissions will be completed within 15 minutes or less.

Step 4: Government Review and Mediation

After it has been submitted, the department will look over the documents to confirm jurisdiction, and that there is enough evidence to substantiate the complaint.

A consumer protection officer is then appointed to your case, representing it and getting in touch with all parties. The officer brings about a negotiated outcome between the consumer and the dealership while trying to avoid litigating a case.

If technical reports detect any hidden flaws or the breaking of legislation protecting consumers, the dealership could be required to fix the vehicle, offer financial restitution and also settle with the customer or take the vehicle back.

Step 5: Escalate the Matter if Necessary

If mediation is unsuccessful or the dealership is not co-operative, the dispute can be brought before the Consumer Disputes Committee or local court.

In cases where the claim is for a lower amount, the Small Claims Court may be faster in providing a resolution. Many times consumers do not need to hire a lawyer to pursue their claims making access to the process more readily available and less costly.

Common Mistakes to Avoid

Do not post negative comments or accusations on social media, regarding the dealership while the complaint is being considered. Under the UAE cybercrime and defamation laws, this might also give rise to additional liability for the public statements.

Also, don’t sign off on big repairs at an independent shop prior to the grievance being addressed. Modification of the vehicle could impact on the evidence and the strength of your case if investigation is required.
